Bitly Terms of Service

Agreement Overview
Bitly, Inc. and its affiliates (collectively "Bitly") provide URL shortening, custom-branded links, link management, link-in-bio, QR code and analytics services. By creating an account, purchasing a paid account, or using Bitly Services and APIs, you agree to be bound by the Terms of Service, Acceptable Use Policy, Privacy Policy, and DMCA Copyright Policy. If you do not agree, you must stop using the services.
Arbitration and Class Action Waiver
The agreement includes a binding individual arbitration clause and class action waiver. You waive your right to a jury trial and to participate in class or representative actions, subject to the terms in Section 12 of the Bitly Terms.
1. Scope and Modifications
Bitly may modify the agreement and services at any time. Changes become effective on the Last Updated date. Continued use means acceptance. Bitly may add, remove, suspend, discontinue, or update features, including destination preview and support tiers.
2. Paid Accounts
Paid plans are subscription-based and billed on a recurring cycle. Fees are generally non-refundable unless required by law. Users authorize recurring charges on the selected payment method and are responsible for taxes and timely payment.
3. Use of Services
Use is non-exclusive, non-transferable, and subject to Bitly policies. Credentials must remain confidential. Bitly may monitor use for compliance and may suspend or terminate accounts for policy, security, or legal violations.
4. Your Services and Content
You are responsible for your own services and content. You grant Bitly a license to process submitted materials for service delivery and business purposes. You must have legal rights to any uploaded content.
5. Intellectual Property and Restrictions
Bitly owns Bitly Materials. Feedback may be used by Bitly without compensation. Prohibited actions include reverse engineering, abusive/malicious use, bypassing security, and creating competing URL-shortening services based on Bitly Services.
6. Term and Termination
The agreement starts upon acceptance and continues until terminated. Paid subscriptions renew automatically unless canceled. Upon termination, access ends and confidential information must be returned or destroyed where required.
7. Confidentiality
Each party must protect the other party's confidential information and use it only as permitted by the agreement. Injunctive relief may be sought for breaches.
8. Data Protection
You are responsible for compliance with applicable privacy laws (e.g., GDPR/CCPA/CPRA). If required, the Data Processing Agreement (Appendix A) applies to processing of personal data.
9. Warranties and Disclaimers
You warrant lawful use and required permissions. Bitly Services are provided "as is" and "as available" without warranties. Bitly disclaims implied warranties and does not guarantee uninterrupted or error-free services.
10. Indemnification
You agree to defend and indemnify Bitly against third-party claims arising from your content, services, or legal/policy violations.
11. Limitation of Liability
Neither party is liable for indirect or consequential damages as detailed in the agreement. Aggregate liability is limited as described in Section 11.2, except where otherwise required.
12. Governing Law and Disputes
For US/non-EU users, New York law and arbitration terms apply. For EU users, Germany law and designated forum/arbitration terms apply, as described in Section 12.
13. Miscellaneous
Includes relationship of parties, entire agreement, force majeure, assignment, notices, export controls, US government use restrictions, severability, and publicity rights.
14. German Personal Use Customers
Contains withdrawal/cancellation rights for consumers contracting with Bitly Europe GmbH, including timing, process, and consequences.
Appendix A - Data Processing Agreement (DPA)
Appendix A defines processing roles, data subject rights, subprocessors, security controls, incident handling, deletion/return, and international transfer mechanisms (SCC/UK Addendum), plus schedules and annexes.
